This End User License Agreement (EULA) is a legal agreement between you (the “User”) and Cook Forever Sàrl, a company registered at Boulevard Georges-Favon 45, 1204 Geneva, Switzerland (“Cook Forever,” “we,” “our,” or “us”).

By downloading, installing, or using the Cook Forever application (the « App »), you agree to comply with these Terms of Use. If you do not agree with these terms, do not use the App.

2. PURPOSE OF THE APPLICATION

Cook Forever is a digital platform that connects private home cooks and customers. It allows users to:

• Offer homemade dishes for sale (for home cooks).
• Browse available meals and place orders (for customers).

Cook Forever is not a food vendor and does not participate in transactions between users. Home cooks are fully responsible for the preparation, hygiene, and delivery of their food.

3. USER ELIGIBILITY

To use the App, you must:

• Be at least 18 years old or have parental consent.
• Provide accurate registration information.
• Not be banned from using similar platforms.
• Comply with applicable food safety laws in your country.

Cook Forever reserves the right to verify user identity and request additional documentation to confirm eligibility.

4. RESPONSIBILITIES AND DISCLAIMERS

4.1 Responsibilities of Home Cooks

Home cooks must:

• Follow food hygiene and safety regulations applicable in their country.
• Ensure that their kitchen and equipment meet health standards.
• Provide accurate descriptions of their dishes, including allergens.
• Take full responsibility for any foodborne illnesses or health issues related to their meals.

4.2 Responsibilities of Customers

Customers must:

• Carefully check meal descriptions before ordering.
• Accept that Cook Forever does not guarantee meal quality or safety.
• Take responsibility for any food allergies or dietary restrictions.

4.3 Disclaimers

• Cook Forever does not inspect, control, or verify meals offered by home cooks.
• We do not guarantee the availability, accuracy, or quality of meals.
• Cook Forever is not liable for disputes between users (e.g., incorrect orders, missing ingredients).
• Users agree to use the platform at their own risk.

5. REFUNDS & CANCELLATIONS

• No refunds are possible once a transaction is made.
• Customers must resolve disputes directly with home cooks.
• If a transaction violates Cook Forever’s policies, we reserve the right to investigate and take action, but we do not guarantee refunds.

6. USER ACCOUNTS & DATA PRIVACY

6.1 Account Creation

Users must create an account with valid information. Cook Forever reserves the right to:

• Suspend or ban accounts violating our terms.
• Modify or remove content that breaches our policies.
• Restrict access to the platform if necessary.

6.2 Data Collection & Privacy

Cook Forever collects and processes user data in compliance with GDPR and other data protection laws.

• Users can modify or delete their data upon request.
• Cook Forever does not sell personal data to third parties.

7. INTELLECTUAL PROPERTY

• All content on the platform (including images, texts, and user-generated content) is owned by Cook Forever.
• Users grant Cook Forever a non-exclusive, worldwide license to use, display, and distribute uploaded content.
• Users cannot copy, modify, or distribute Cook Forever’s proprietary assets without permission.

8. SUBSCRIPTIONS & PAYMENTS

• Cook Forever offers an optional paid subscription for additional features.
• Payments are handled by third-party providers (e.g., Stripe, PayPal).
• Cook Forever does not take a commission on transactions between users.
• Subscription fees are non-refundable unless legally required.

9. PROHIBITED ACTIVITIES

Users must not:

• Use Cook Forever for illegal, fraudulent, or harmful activities.
• Sell expired, unsafe, or misrepresented food.
• Create multiple accounts to bypass restrictions.
• Upload offensive, inappropriate, or copyrighted content without permission.

Violating these rules may result in account suspension or legal action.

10. TERMINATION OF SERVICE

Cook Forever reserves the right to:

• Suspend or terminate accounts violating these terms.
• Discontinue the platform or certain features at any time.
• Modify these terms with or without notice. Continued use of the App means acceptance of any updates.

11. JURISDICTION & DISPUTE RESOLUTION

• These Terms are governed by the laws of Switzerland, France, and Belgium, depending on the user’s location.
• Any disputes shall be handled under the competent courts of Geneva, Switzerland, unless otherwise required by local laws.
• Users agree to attempt mediation before taking legal action.

12. FINAL PROVISIONS

• If any clause in this EULA is found unenforceable, the rest of the agreement remains valid.
• Cook Forever reserves the right to update these terms at any time. Users will be notified of significant changes.
• Users must comply with all local food safety laws when using the platform.
